USML CLASSIFICATION UNDER THE ITAR International Traffic in Arms Regulations The International Traffic in Arms Regulations (ITAR) details the regulations governing the export of defense related materials and technologies. It provides definitions of important terms, with information and procedures for registration, licenses, agreements, general policies, violations, penalties and administrative procedures. U.S. Munitions List The U.S. Munitions List (USML) categorizes goods and technologies governed by the ITAR. Defense trade controls are applicable when exporting military-related goods and technologies from the United States. It's the exporter's responsibility to ensure proper classification of these controlled goods and to maintain compliance with the ITAR. All exports categorized in the USML require an export license, although some license exemptions are available under very specific circumstances. Some items in the USML are identified as Significant Military Equipment (SME), which are even more closely controlled and monitored. For example, parts and attachments for an automatic firearm are not considered SME, but a fully automatic firearm is defined as SME. Exporters of military defense items are familiar with the USML and the ITAR, however companies that export civilian items may not be aware that some of their products are "dual-use" items, and might fall under defense trade controls. Dual-use items are civilian products with military applications. For example, electronic equipment or lenses manufactured for civilian cameras that are also used in military tracking devices. The USML consists of 21 categories from firearms and electronics, to vessels of war and missile technology, to nuclear weapons and biological agents. For example, Category XI(a)(3) is for military electronic equipment that is specially designed for radar systems with capabilities such as search, acquisition and tracking.
